Definition of "Valid User" re. University of South Carolina Site License with Environmental Systems Research Institute

The language in our contract with ESRI indicates that a qualified user of their software is someone who is either:

1) presently matriculating at the University (via an enrollment for classes or some other official designation as a student) - or

2) is an employee of the University of South Carolina Columbia campus

AND

that the use of the software will be for teaching, coursework, instruction or funded-research that relates to their University affiliation.

As such, this puts applications such as using the software for enterprise solutions (work management systems, campus infrastructure needs) and research that is based off-campus or uses non-USC equipment and/or facilities in very gray areas. We the Geography Department as administrators of the license, and on behalf of the University Office for Reseach's funding the license, must occasionally deny requests or ask for documentation regarding relationships or uses in order to maintain a functioning relationship with all parties involved. ESRI reserves the right to monitor and restrict the use of its software under this license. We request that all of our users refrain from any uses that may put this agreement in jeopardy.
