Overview

The Sociological Movement in Law: The American Tradition 

Oliver Wendell Holmes, Jr. (1841-1935). “Against legal formalism, Holmes argues that the law is a reflection of a nation’s development.” (p.99)

Roscoe Pound (1870-1964): “The emphasis in sociological jurisprudence is... on the actual workings of the law... Pound phrases this difference in perspective in the now famous distinction between law in action and law in the books...” (p.100)

Karl Llewellyn (1893-1962): “To Llewellyn, the question must always be if, when, and to what extent law as proscribed rule and law as actual practice actually converge or not.” (p.103)

The Legal Origins of the Sociology of Law
